Waiver

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

ASSUMPTION OF RISK

1. I, the undersigned, wish to play or for my dependant(s) to play Tactical Laser Tag from ESCAPE MAZE INCORPORATED, I recognize and understand that playing Tactical Laser Tag (hereinafter called the “Game”) involves certain risks. Those risks include, but are not limited to, the risk of injury resulting from possible malfunction of the equipment used in the Game, negligence of employee or management and injuries from tripping, falling over, falling onto or into obstacles in the Game playing field. These objects may be rough, jagged or unfinished surfaces. In addition, I recognize that the exertion of playing the game could result in injury or death. Playing Tactical Laser Tag Outdoors involves certain environmental, weather, nature based and pests based (such as, but not limited to: bee stings, mosquito and tick bite) risks. In addition, The arena has a dirt floor which can be uneven or contain some stones which could result in a tripping hazard. The dirt floor may also become slippery when wet or dusty when dry.  I recognize that these risks could result in injury, medical conditions or death.
2. Despite these and other risks, and fully understanding such risks, I wish to play or for my dependant(s) to play the Game and hereby assume the risks of playing the Game. I also hereby hold harmless the “Sponsors” and indemnify them against any or all claims, actions, suits, procedures, costs, expenses (including attorney’s fees and expenses), damages and liabilities arising out of, connected with, or resulting from my playing the Game, including without limitation, those resulting from the manufacture, selection, delivery, possession, use or operation of such equipment. I hereby release the ESCAPE MAZE INCORPORATED from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, my representatives, my dependants and assigns. I hereby certify that I or my dependant(s) are in good health, are an appropriate age to participate in the Game, and do not suffer from a heart condition or other ailment which could be exacerbated by the exertion involved in playing the Game.
3. I further certify that I am 18 years of age or older.

In consideration of participating in the “Game”, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against ESCAPE MAZE INCORPORATED their directors, officers, employees, agents and representatives (all of whom are hereinafter collectively referred to as “the Releasees”);
2. TO RELEASE THE RELEASEES from any and all liability from any loss, damage, injury or expense that I may suffer or that my next of kin may suffer as a result of my participation in Tactical Laser Tag due to any cause whatsoever, INCLUDING NEGLIGENCE OF THE PART OF THE RELEASEES;
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my participation in Tactical Laser Tag; and
4. That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns, in the event of my death.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.

BY SIGNING THIS DOCUMENT YOU AND/OR YOUR DEPENDANT(S) AGREE TO COMPLY WITH ALL RULES, REGULATIONS AND POLICIES OF ESCAPE MAZE INCORPORATED.

1. I or my dependant(s) agree to always wear the safety equipment provided by ESCAPE MAZE INCORPORATED; and that I or my dependant(s) will not alter or take the safety equipment off while participating in the Game.
2. I or my dependant(s) agree to return the safety equipment to ESCAPE MAZE INCORPORATED, prior to leaving the premises.
3. I or my dependant(s) agree to follow the Game Rules while participating in the Game:
   a. to always follow the Game Warden’s directions;
   b. to never run;
   c. to never climb;
   d. to never use excessive force towards other people, the equipment, or the arena;
   e. to always keep one hand on the Falcon Tagger during the Game;
   f. to never take off the Headband while in the arena;
   g. to remain in the briefing area at the end of the Game until instructed.
   h. to stay within the gaming area during the Game play.
   i. not to move or alter any object, obstacles, barriers or equipment.
4. In consideration of participating in the “Game”, I hereby agree to compensate ESCAPE MAZE INCORPORATED. within 14 days in full for any and all broken, damaged or unreturned equipment; as a result of my or my dependant(s) actions.
5. I acknowledge that I or my dependant(s) must be 6 years of age or older to participate in the game. I understand that I or my dependant(s) must be able to hold, carry and operate the Falcon Tagger during the Game without assistance.
6. I acknowledge that ESCAPE MAZE INCORPORATED may obtain photographs and videos in connection with my participation in the Game.

I OR MY DEPENDANT(S) HAVE READ AND UNDERSTOOD THE RULES, REGULATIONS AND POLICIES OF ESCAPE MAZE INCORPORATED, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I HAVE AGREED TO THESE RULES, REGULATIONS OR POLICIES.
I OR MY DEPENDANT(S) UNDERSTAND THAT BY VIOLATING ANY OF THESE RULES, REGULATIONS OR POLICIES, IT MAY RESULT IN MY PARTICIPATION IN THE GAME TO BE TERMINATED WITHOUT WARNING AND COMPENSATION.
